Peer #1 Laura Response due in 48 hours (50- 75words)After reviewing the U.S. Department of Health and Human Services (HHS) website to see the most up-to-date healthcare law information, I discovered two interesting facts that I was not aware of. The first is that the HHS finalized the ruling for regulatory reform through retrospective review under the Regulatory Flexibility Act (RFA). This regulation is also called the SUNSET rule. It fosters accountability and transparency in the HHS department. Likewise, it requires a thorough assessment of regulations every ten years to determine if the regulation is still needed, and whether it is having the appropriate impact in a timely manner (U.S. Department of Health and Human Services [HHS], 2021). This ruling will deliver smarter, less burdensome regulations that will be assessed every ten years for effectiveness. In the field of prevention, this ruling will create a positive impact. For example, during the pandemic, the HHS had to categorize and suspend obsolete regulations that would impose unnecessary costs to the public. This slowed the delivery of needed care. With the RFA, HIPAA-compliant, communication technologies are now available to help staff and patients receive timely, preventive care, medicine, and support (HHS, 2021). Another interesting fact I learned about is regarding a data-driven initiative. The HHS finalized the MyHealthEData initiative. This initiative is designed to empower patients to access to their personal, medical information in order to make judicious, healthcare decisions (HHS, 2021). This requires public and private entities to share health information between patients and other involved parties. The MyHealthEData will help patients achieve the best preventive care and medical initiatives for their specific conditions, while keeping the information private and secure. This gives personalized care and puts patients in control of their health (HHS, 2021).Reference:U.S. Department of Health and Human Services (HHS). The HITECH act under this legislation provides access to healthcare quality, safety, and efficiency through health IT, that includes electronic health records and private and secure electronic health information exchange (HealthIT, 2021). This information is beneficial to the field of prevention, because it provides incentives for the use of Health IT that can be helpful to community health programs that offer any type of mental health or health services. These incentives could be grants or loans that immediately fund for the infrastructure of Health IT (HealthIT, 2021).There is another law called the FDASIA (Food and Drug Administration Safety and Innovation Act) that is under the Health IT Legislation. The FDASIA is a workgroup that provides expert advice on any discrepancies that is collaboratively identified by three other organizations. They aim to identify any risks or issues that may inhibit the innovation, patient safety of health information technology (HealthIT, 2021). This information is important, because it helps to limit risks that may expose patient safety, or duplicate records, which maintains the database’s integrity.HealthIT. (2021). With that is the Cures Act which improves the flow of information from different healthcare providers. This is huge not only for the patient but also the provider because it allows for a full picture of the patient. By not having to explain your past history over and over again and giving the provider a more accurate picture of the patient as a whole, this allows for more accurate and complete treatment.Inclusivity and understanding other people’s cultures, religions and beliefs is critical to any patient’s well-being and success but it is also imperative for a provider to be effective. The OCR enforces laws and regulations to make sure programs are non discriminatory. Being aware of these laws and regulations will help the provider to be culturally responsible, which will give peace of mind to the patient and the clinician. For many going to counseling sessions is a very uncomfortable experience, but if they could feel safe knowing that the provider is culturally responsible it leaves everyone feeling more comfortable.
