Negligence is a failure to take reasonable care or steps to prevent loss or injury to another person. This tells me that this was an accident and not intentionally. For example, negligence would be failing to warn your patient about a treatment’s risks. The doctor must warn his patients of the dangers of treatment. So, if you have a patient that needs to be educated about the risk that might happen during tooth extraction, this can be classified as negligence.
Medical malpractice happens when a health care professional or provider neglects to provide appropriate treatment causing harm, death, or injury. An example of malpractice is when a health care provider operates on the wrong body part or removes the wrong body part (Hyman & Silver, 2004). Suppose you have a surgeon who takes a patient into the operating room and has not confirmed what limb needs to be removed and did not follow all the protocols placed by the hospital. Then the surgeon removes the wrong limb, and now the affected limb needs to be removed as well due to the surgeon not following protocols and has caused significant injury to their patient.
