Since certain powers are granted between the federal government and the state it can make it a challenging issue, and where sometimes the federal government will have to get involved. For example, the Supreme Court case Shelby County v. Holder case regarding the constitutionality of the Voting Right Act of 1965 Section 5 and Section 4(b),My professor’s feedback: Great topic Jade! So, I mentioned court cases in your previous message. I would suggest looking into a case called Planned Parenthood v. Casey which is kind of the crux of abortion being a federalism topic. Basically, the SCOTUS acknowledged that the states cannot outright ban abortion but can regulate it…so long as that regulation doesn’t place an undue burden on women seeking one. With this new Texas law, it seems to be a weird challenge to the Casey ruling in that the state is not enforcing the ban, citizens are….is this a sidestep around the current understanding of state regulation of abortion? That’s the question here. Also, look into TRAP laws too.
