Does simply following laws and policies make the employees of criminal justice organizations moral? When employees follow rules, policies, and procedures, are there fewer or greater economic impacts on organizations? Explain your answers.

There is a morality that comes with following rules because it shows that a person has some form of self-discipline. Understanding that someone has to have the self-discipline to follow the rules gives them the freedom and understanding of how to expound upon the rules for their own benefit. After understanding the rules, a person is better able to understand the spirit of the rules. In law, there is a difference between the correct English definition of the law, and the actual spirit of the law. This is also the case with policy. I believe that morality comes with understanding both the dictionary definition of the law and the spirit of the law. I say this all with an astrix. If we go back to the Second World War, there is the story of Reserve Battalion 101. While they are more in the line of military police and not the public servant police, we are accustomed to, they still have the function of enforcing rules on those that the German army conquered. The reserve police battalion were not normal soldiers, they were both retired soldiers from the First World War and conscripted soldiers. The book Ordinary Men: Reserve Police Battalion 101 and the Final Solution in Poland recounts a detailed and disturbing history of how they were used to murder mass amounts of civilians. It also details the psychological decline of these “Ordinary Men” and how they go from electricians, pharmacists, machine workers, to hardened murders because they were following the rules. With this in mind, simply following the rules does not make something moral or immoral.
Looking at an economic impact of following rules, there are most likely reasons that some things are done in a process while others are abstained. In any industry, there has been enough accumulated knowledge for how to do something. This could be the meat packing industry that led to the creation of ratings for meat-based products. For a criminal justice setting, we could look at critical incidents. There is generally a procedure for containing a hazmat situation, for example. If these rules are not followed, there could be consequences for the environment, population, or infrastructure that could have been avoided if specific steps were taken.

The simple act of following a rule, whether its a policy or a law, does not justify somebody as being a person of good moral standards. More people behave out of fear of consequences then they do because it is what they want to do. According to the National Institute of Justice (2021), “The police deter crime when they do things that strengthen a criminal’s perception of the certainty of being caught. Strategies that use the police as “sentinels,” such as hot spots policing, are particularly effective. A criminal’s behavior is more likely to be influenced by seeing a police officer with handcuffs and a radio than by a new law increasing penalties” (Police deter crime by increasing the perception that criminals will be caught and punished). The fear that police will arrest you and you will be punished in the criminal justice system causes people to do the right thing.

The costs saved by staff members doing the right thing is borderline immeasurable. The cost for the employer to find, hire, train, and equip a new hire employee various from business to business, but one thing that is consistent is that it does cost employers. So when employees are loosing their jobs due to punishment for failure to follow rules, regulations, policies, or laws, the employer also then has to spend money to retrain another new employee to take the place of the terminated employee.

In this assignment, you will be critically evaluating the vision, values, mission statement, and goals/objectives of Pepsico.
Keys to the Assignment
After studying the background materials and completing the SLP, you are in an excellent position to evaluate a company’s published mission, vision, values, and objectives/goals. This Case asks you to begin your strategic analysis of Pepsico by evaluating the company’s mission, vision, values, and goals. To do this, observe the following procedure:

Step 1: Visit the official website of Pepsico and identify the company’s vision, mission, values, and goals. (Hint: You will need to do some exploring and a certain amount of speculation—as the terms “vision” and “mission” (and sometimes even the term “company goals”) are used interchangeably. Explore the “Who We Are” and “Investors” (and other) links. Also, be sure that you look closely at the most recent Annual Reports.
Step 2: Critically evaluate the mission, vision, values, and goals (again, you will likely need to make decisions as to which is which). Use the criteria in the background materials to support your assessment of the quality of the company’s mission, vision, values, and goals.
Step 3: Determine which (if any) of the elements consider the goals and needs of specific stakeholder groups. Write down any examples.
Step 4: Consider what changes are needed to improve the vision statement, the mission statement, the statement of company values, and the company’s objectives and goals.
Step 5: Write a 6-7 page paper addressing the above requirements. You must meet minimum length requirements, by responding to each step above with precision and with depth of critical thinking.

Lewis v. Heartland Inns of America, 591 F.3d 1033 (8th Cir. 2010)
The plaintiff in this case is a female who had worked in various capacities for a hotel chain, including temporary stints as a front desk “guest service representative.” Her performance was praised by a number of different supervisors. She was eventually offered a full-time position as a day-time front desk person. The woman was not interviewed prior to the offer. However, when the Director of Operations saw her working at the front desk several weeks later, she told the hotel manager that she was not sure that the woman was a “good fit” for the front desk job. She said that the plaintiff, who is somewhat masculine in appearance; prefers to wear loose fitting clothing, including men’s button down shirts and slacks; avoids makeup; and wears her hair short “lacked the ‘Midwestern girl look.’” The Director of Operations ordered that the women be returned to a night clerk position, a move that was resisted by the hotel manager. Around this time, the hotel chain decided that hiring for the front desk position would require a second interview and it purchased video equipment enabling top managers to see applicants before extending offers. After she had been on the job for about a month, the woman was informed that a second interview would be required in order to “confirm/endorse” her A shift position. The woman was aware of what had been said about her appearance. She told the Director of Operations that she believed a second interview was being required only because she lacked the “Midwestern girl look” and she questioned whether the interview was lawful. The woman was invited to share her views about new policies at the hotel and she suggested that some of them might have contributed to a drop in revenue at the hotel. The woman was terminated three days later, on the grounds that she had “thwarted the proposed interview procedure” and exhibited “hostility toward … recent policies.” [In the course of litigation, “poor job performance” was cited as an additional basis for termination]

EEOC v. Management Hospitality of Racine
666 F.3d 422 (7th Cir. 2012)
The EEOC brought suit on behalf of two servers who alleged sexual harassment under Title VII, resulting in a hostile work environment. The trial court found in their favor, and the employer appealed, relying on the Faragher/Ellerth affirmative defense.  
1. What were the legal issues in this case? What did the appeals court decide?
2. Why does the court agree that the employer failed to exercise reasonable care to prevent harassment? Why was its harassment policy not sufficient?
